Terms of sales Morin 24

PREAMBLE

These General Terms and Conditions of Sale come into force on the date they are put online and will be enforceable on the date of the Customer's first use of the Site's sales area.

These General Terms and Conditions of Sale apply throughout the period of use of the Site's sales area and until new General Terms and Conditions of Sale replace the present ones.

The Vendor reserves the right to modify certain provisions of these GCS at any time. These modifications or adaptations are enforceable against the Customer as soon as they are put online and cannot be applied to contracts concluded previously.

Any use of the Site's sales area by the Customer after the modifications to the general terms and conditions of sale constitutes acceptance by the Customer of the new general terms and conditions.

Each purchase from the Site's sales area is governed by the GCS applicable at the date of the order.

Validation of the order by the Customer implies unreserved acceptance of these terms and conditions.

These conditions of sale govern the sale of all products, taken together or separately and regardless of quantity.

The customer declares that he/she has read the following provisions and accepts them before placing his/her order.

All the Products presented on the Site are original creations individually manufactured in France. In general, the Products offered for sale, their main characteristics and in particular the type of precious metals used, specifications, illustrations and dimensions are presented on the Site.

The Customer is required to refer to the description sheet for each Product in order to find out about its properties and essential particularities.

The photographs presented in the online sales area are as accurate as possible, but cannot guarantee perfect similarity with the Product purchased. In particular, color variations may occur, notably due to the technical limitations of color rendering on computer equipment. The Vendor cannot be held responsible for any non-substantial errors that may occur.

 

DELIVERY TIME

Delivery time depends on two things:

1.           Order preparation time

2.           Choice of shipping method

The delivery time is indicated when choosing the delivery method on the site, before finalizing the order.

Delivery times are given as an indication and should not be considered as final deadlines.

The estimated shipping date can be seen in the customer's account in the “Order history” area, then in “Initial shipping date”.

Exceeding these deadlines does not oblige the seller to compensate the customer financially. Commercial gestures remain at the discretion of the seller.

Under each item is availability information:

- “Available within 15 working days”.

 

Orders are prepared and dispatched on average within 15 working days, each item sold being prepared manually by your watchmaker.

Ordering time includes assembling the parts and checking that the mechanism works properly.

 

Shipping method chosen by the customer:

It is the customer who chooses at the time of finalizing his order his shipping method among those proposed by the site.

MONDIALRELAY: the average delivery time is 4 to 10 days after dispatch.

In the event of stock availability not conforming to what we have confirmed, you will be informed by e-mail of the cancellation of this order.

 

Transfer of ownership

Article L 216-2 of the French Consumer Code: “All risk of loss or damage to the goods is transferred to the consumer at the time when the latter or a third party designated by him takes physical possession of the goods.

The customer becomes responsible for the products received once he/she has accepted delivery of the parcel without expressing any duly qualified reservations regarding its packaging.

ATTENTION: Upon receipt or collection of the order, and before the departure of the carrier where applicable, the Customer must open the package containing the Products ordered and check them for conformity and quantity.

To this end, the Customer will sign a delivery note or a transport note. He/she must make the necessary reservations, detailed, legible and as precise as possible in the event of any anomalies observed (breakage, damage, non-conformity: product error, colors, dimensions, missing items, etc.).

In this case, the Customer must refuse delivery of the package. He must also confirm their reservations by registered letter with acknowledgement of receipt addressed to the carrier in charge of the faulty delivery and to the Vendor's customer service department, specifying the number of the order concerned, within three (3) working days of delivery. Once this period has elapsed, and if these formalities have not been complied with, the Products will be deemed to be in conformity and free from any apparent defect.

In the event of proven non-conformity, or if the Vendor agrees to take back the Products on a commercial basis, the Products concerned will be reshipped within the limits of available stocks. Failing this, the Vendor will cancel the unavailable order and reimburse the customer.

In the event of an accepted delivery which the Customer considers to be in conformity, the Customer will be asked to send a photograph of the Product which the Customer considers to be non-compliant to the Customer Service Department.

ATTENTION: In the absence of reservations, or in the event of insufficient reservations, the Vendor reserves the right to refuse to take back, exchange or reimburse the Products. Once the Customer has signed the delivery note, without any specific reservations, the carrier and the Vendor will be released from any liability for any damage caused during the delivery operations. It should be noted that statements such as “subject to unpacking” have no legal effect and do not release the Customer from his duty to check the condition of the Products delivered.

If, for any reason whatsoever, the carrier's personnel do not allow the Customer time to check the condition of the Product (quantity and quality), it is imperative that this be specified on the delivery note and countersigned by the carrier's personnel, and failing this, that the Customer Service Department be notified as soon as possible.

In accordance with article L.221-15 of the French Consumer Code, we cannot be held responsible for the loss or deterioration of the package if the fault is attributable to the consumer, to force majeure or to the actions of a third party.

 

PRICES

Prices shown are inclusive of VAT (article 293B of the French General Tax Code). These prices do not include postage, packaging and parcel preparation costs (according to the current rates). Any change in the applicable rate may be reflected in product prices.

 

SHIPPING COSTS

Postage to MONDIALRELAY relay points in France and EU countries is free of charge.

 In the case of a parcel returned to the sender for reasons of “unclaimed parcel” or “refused” or “incomplete address” or “does not live at the address indicated”, it will be the customer's responsibility to pay postage again to receive the parcel.

MORIN MOD may provide a photo of the returned package in the case of a return to sender.

Any claim made more than 30 days after non-delivery cannot be taken into account.

 

PAYMENT

The parcel will only be sent once payment has been received. Products remain the property of MORIN 24 until full payment has been received.

For this reason, in the event of a glaring error in an advertised price, the order concerned by the presence of this item will be cancelled and reimbursed as soon as possible.

- Payment methods

Orders can only be paid for by paypal.

 

RETRACTION

Consumers may exercise their right to withdraw from a distance contract as soon as the contract has been concluded and within a maximum period of fourteen days from receipt of the goods, without having to justify their decision or incur any costs other than the cost of returning the goods.

COMPLAINTS

In application of the provisions of article L. 221-18 of the French Consumer Code, you have a period of 14 days from receipt of the products to exercise your right of withdrawal, without justification or penalty.

In the case of insured parcels: if the parcel arrives open or damaged (in particular with the presence of the yellow “La Poste” tape) it is essential that the customer immediately draws up a “spoliation report” (report 170 for the post office) so that MORIN MOD can open an investigation and compensation procedure.

The consumer must then, within 14 days, send a copy of this “spoliation report” by e-mail to morin24contact@gmail.com Any claim received after this deadline will be rejected.

Delivery errors / non-conforming products: The consumer must notify MORIN 24 within 14 days of delivery of any claim of delivery error and/or non-conformity of the products in kind or in quality. Any claim made after this deadline will be rejected without recourse.

In order to be accepted for return by our after-sales service, the product must be returned: undamaged (no signs of wear) and complete (i.e. in perfect condition for resale) in its original packaging, accompanied by any accessories (batteries, chargers, bracelet, links, etc.), instructions for use, warranty card if present. If any items are missing, or if the product shows irreversible signs of use, the customer will be notified by e-mail, and the return will be refused and sent back to the sender.

 

The consumer must send a retraction/complaint request by e-mail to morin24contact@gmail.com

Any claim not made in accordance with the above rules and within the specified time limits will not be taken into account and will release MORIN 24 from any liability to the consumer.

In the case of a partial return of the order, the price of the product(s) purchased will be reimbursed on condition that they are returned in perfect condition, unused, and not removed from their original packaging duly sealed.

Refunds will only be processed once the returned products have been received and checked at MORIN 24 headquarters (address below).

Items returned spoiled, incomplete, damaged or soiled by the customer will not be accepted. If the defective goods are not claimed within one week, they will be automatically destroyed.

If the color or quality of a product is not to the customer's liking, the return costs will be at the customer's expense.

 

GUARANTEES

All timepieces sold on the site are guaranteed for 2 years, to cover malfunctions excluding misuse and normal wear and tear.

Shipping is the responsibility of the customer. The invoice will be enclosed with the parcel.

PERSONAL DATA

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, you have the right to access and rectify your personal data.

To do so, simply send us a request online or by post, giving us your contact details (surname, first name, address).

MORIN 24 undertakes not to divulge your personal information to third parties. This information is confidential. They will only be used by the sales department to process your orders, and to inform you of new arrivals.

APPLICABLE LAW AND JURISDICTION

Should any of the clauses of this contract be rendered null and void by a change in legislation, regulations or by a court decision, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.

The present conditions are subject to French law. In the event of a dispute, the competent court will be that of the defendant's place of residence.
